About Deceptive Trade Practices in Dallas-Fort Worth

While most states have similar consumer protection laws, the Texas DTPA differs in that it defines a “consumer” to include individuals as well as businesses with less than $25 million in assets. In short, the law can apply to many types of commercial transactions involving up to $500,000 as well as ordinary consumer purchases.

The DTPA automatically deems a wide range of false, deceptive, and misleading practices violations, including:

  • False or deceptive advertising
  • False or misleading statements used to induce a sale
  • Making false statements about or disparaging a competitor
  • Misrepresenting the terms of an agreement, guarantee, or warranty
  • Failing to disclose material information about the goods or services sold
  • Misrepresentations in real estate transactions
  • Price-gouging during an emergency or natural disaster
  • Misrepresenting a home or roof repair as completed when it was not
  • Fraud and deceptive practices in construction or improvements
  • Bad faith insurance denials and other violations of the Texas Insurance Code
  • Unfair debt collection
  • Deceptive investment schemes
  • Breach of an express or implied warranty
  • Any other “unconscionable” act or practice

Certain Exemptions

While the list of violations is far-reaching, certain commercial transactions are exempt from the DTPA, such as:

  • Transactions under a written contract valued at more than $100,000 in which the consumer had legal counsel (excluding transactions involving a residence)
  • Any transaction over $500,000 that does not involve a consumer’s residence

The best way to protect your rights and interests is to work with an experienced Texas deceptive trade practice attorney. That’s where Ryan G. Cole Law can assist you. Our firm has a proven history of achieving positive outcomes in arbitration and court proceedings.

Available Remedies Under the Texas DTPA

If you’ve been harmed by deceptive trade practices, the DTPA offers a range of legal remedies and potential damages, including:

  • Actual damages – Victims can recover any actual monetary losses they’ve incurred due to deceptive practices.
  • Mental anguish – In certain cases, consumers can be awarded damages for mental anguish they’ve suffered as a result of the deceptive act.
  • Punitive damages – In cases of particularly malicious or intentional misconduct, the courts might award punitive damages to punish the wrongdoer and deter similar future actions.
  • Attorney’s fees – The DTPA allows for the recovery of reasonable and necessary attorney’s fees for the prevailing party.
  • Statutory damages – In some instances, victims can be awarded up to three times the amount of their actual damages if the act was committed knowingly.
  • Injunction – Courts have the authority to issue injunctions, preventing businesses from continuing their deceptive practices.

Finally, the court may order additional relief, such as the appointment of a receiver, revocation of a defendant’s license or certificate to do business, or any other relief it deems proper. With Ryan G. Cole by your side, you gain an ally who will fight for the compensation and justice you deserve.
